EASEMENTS AND ENCROACHMENTS

Throughout the South and Center Chautauqua Lake Sewer Districts, sewer lines and / or appurtenances had to be placed on private property. In these cases, Easements were granted to the Sewer Districts. In the areas of Vacuum sewers and Low Pressure Grinder sewers, almost every vacuum tank or grinder tank was installed on private property. In some instances, Gravity sewers also needed to be installed across private property.

The Easement is a legal and binding instrument that "grants unto the District, its successors and assigns, full and free right and authority to lay, construct, maintain, repair and replace sewer pipe lines and necessary appurtenances through the following described parcel of land:".

"The extent and limitations of such easements shall be as follows except to the extent that the conditions of this paragraph are modified below in this instrument. After construction, the surface of the land will be restored to as good or better condition as existed prior to construction. The owner shall retain the right to use the surface and subsurface of the easement as long as such does not interfere with the integrity of and access to the district's facilities. The owner agrees to notify the district in advance of anything they bury within the boundaries of the permanent easement. The district shall bury its pipelines at least three feet below the surface of the land. The owner shall not place or permit to be placed any house, structures or obstructions on the permanent easement and shall not change the earthen cover of the pipeline more than one foot from the existing grade without the written permission of the district. The district will not interfere with the possession of the surface of the easement by the owner except to the extent necessary to lay, construct, maintain, replace and repair its pipelines and appurtenances and the district's right to ingress and access upon the owner's property is limited to the boundaries of the easement granted by the owner."

ENCROACHMENTS

Encroachments are when the above easement is not followed and a structure is within the easement or that access has been compromised. Encroachments may be handled in many ways, including legal action.

We ask that you do not build within an easements' boundaries, that you do not obstruct the access to the districts vacuum valves, grinder tanks or control panels, manholes, etc.
